This privacy notice explains how I collect, use, store and protect your personal information when you:

  • visit www.listeningfield.ie;

  • contact me or join my mailing list;

  • create an account or access online materials;

  • book or purchase a session, course, event, retreat or membership;

  • participate in an online or in-person offering; or

  • work with me through one-to-one sessions.

I use the name The Listening Field for my work and website. The Listening Field is not a separate company or legal entity.

2. Who Is Responsible for Your Information?

Lucia Guerin is the data controller for the personal information collected through The Listening Field.

I am a sole trader operating under my own name, Lucia Guerin, and I offer my work through the name and website The Listening Field.

3. What Information I Collect

Depending on how you engage with me, I may collect the following information.

Contact and account information

This may include your:

  • account or membership details; and

Booking, purchase and participation information

This may include:

  • the sessions, courses, events, retreats or memberships you have booked;

  • dates of attendance;

  • payment status;

  • invoices and transaction records;

  • correspondence relating to your booking; and

  • information needed to provide access to online materials.

Payment card information is normally processed directly by the payment provider used at checkout. I do not generally receive or store your full payment card details.

Communications

I may keep information you provide when you contact me by email, telephone, contact form, social media, WhatsApp or another messaging service.

This can include enquiries, feedback and other correspondence.

Please do not include detailed health or medical information in the general contact form on my website.

One-to-one client information

If you work with me individually, I may collect information that is relevant to providing sessions safely and sensitively. This may include:

  • information provided on a confidential client form;

  • relevant health and well-being information;

  • accessibility or support needs;

  • your preferences and boundaries;

  • consent relating to particular practices;

  • emergency contact details; and

  • brief factual notes relating to our sessions.

For an in-person session, the confidential client form is normally completed when you arrive for your first appointment. We will review anything relevant together before beginning the practical part of the session.

Website and technical information

When you use the website or online services, certain technical information may be collected automatically. This can include:

  • your IP address;

  • browser and device information;

  • pages visited;

  • the date and time of your visit;

  • website activity; and

  • information collected through cookies or similar technologies.

Photographs, recordings and contributions

Some online group sessions, courses or events may be recorded so that a replay can be made available to participants or members. You will be told when a session is being recorded.

Where possible, recordings will focus on the facilitator or speaker. You may choose to keep your camera and microphone switched off if you do not wish your image or voice to be included.

One-to-one sessions are not recorded unless this has been discussed and you have given your clear permission.

I will ask for permission before using an identifiable photograph, recording, testimonial or personal contribution for publicity or promotional purposes.

4. How I Collect Your Information

I may collect personal information:

  • directly from you when you complete a form, make a booking, create an account, send an email or speak with me;

  • through your participation in a session, course, event, retreat or community;

  • automatically through the website and cookies;

  • through the website, course or payment platforms used to provide my services; or

  • from an organisation that has arranged or paid for a programme in which you are participating.

Where an organisation has arranged a programme, I will only request or receive the information reasonably needed to communicate with you and provide the programme.

5. Why I Use Your Information

I use your personal information to:

  • respond to enquiries;

  • arrange and manage bookings;

  • provide sessions, courses, events, retreats and memberships;

  • give you access to online resources and recordings;

  • communicate practical information and changes;

  • process payments and maintain financial records;

  • provide one-to-one work safely and appropriately;

  • maintain appropriate professional and client records;

  • send email updates where you have agreed to receive them or where otherwise permitted;

  • operate, protect and improve my website and services;

  • meet legal, accounting, insurance and professional obligations; and

  • respond to a serious and immediate safety concern where necessary.

6. My Lawful Bases for Processing

Under data protection law, I must have a lawful basis for using your personal information.

Depending on the circumstances, I rely on one or more of the following:

Contract

I process information where it is necessary to arrange or provide something you have requested or purchased, such as a session, course, event, retreat or membership.

Consent

I rely on your consent for activities such as:

  • sending certain marketing communications;

  • using identifiable photographs, recordings or testimonials;

  • recording a one-to-one session; or

  • processing health and well-being information where explicit consent is required.

You may withdraw your consent at any time. Withdrawal will not affect processing that took place before consent was withdrawn.

Legal obligation

I may need to process and retain information to comply with tax, accounting, legal or regulatory requirements.

Legitimate interests

I may process information where it is reasonably necessary to:

  • respond to you;

  • administer my work;

  • maintain appropriate records;

  • protect the security of my website and systems;

  • improve my services; or

  • establish, exercise or defend a legal claim.

I will only rely on legitimate interests where these interests are not overridden by your rights and interests.

Vital interests

In a rare emergency, I may use or share relevant information where this is necessary to protect your life or safety, or the life or safety of another person.

7. Health and Other Sensitive Information

Health and well-being information is classed as special-category personal data and receives additional protection under data protection law.

I collect this information only where it is relevant to the safe and sensitive provision of one-to-one work or another offering. I normally rely on your explicit consent to process it.

You do not need to provide extensive medical details. You may write or say “prefer to discuss” and speak with me privately instead.

If you do not provide information that is necessary for safe participation, I may need to adapt, postpone or decline a particular practice or session.

Health information is not used for marketing.

8. Email and Marketing Communications

I may send you news and information about courses, sessions, events, retreats and other Listening Field offerings if:

  • you have subscribed to receive these emails;

  • you have asked to receive information; or

  • I am otherwise permitted to contact you about a related service.

You can unsubscribe at any time by clicking the unsubscribe link in an email or by contacting info@listeningfield.ie.

Unsubscribing from marketing will not prevent me from sending practical information relating to something you have booked or purchased.

I do not sell your personal information or share it with another organisation for its own marketing.

9. Cookies and Website Analytics

The website may use cookies and similar technologies to:

  • make the website and member areas function properly;

  • remember your preferences;

  • keep the website secure;

  • understand how visitors use the website; and

  • measure the effectiveness of communications or promotions.

Strictly necessary cookies may operate without consent because they are required for the website to function.

Where consent is required for analytics, advertising or other non-essential cookies, you can accept or reject them through the website’s cookie settings. You can also change your browser settings to block or delete cookies.

Some website features may not work correctly if necessary cookies are disabled.

10. Who I May Share Information With

I share personal information only where it is necessary and appropriate.

This may include:

  • Kajabi, which hosts my website, mailing list, online courses, community and member accounts;

  • Zoom, where online sessions, meetings and events take place;

  • payment providers used to process purchases;

  • email, calendar, cloud-storage, accounting and administrative service providers;

  • my accountant, insurer, legal adviser or other professional adviser;

  • a professional supervisor or mentor, normally using anonymised information;

  • venues, facilitators or collaborators where limited information is required to provide an event or programme;

  • public authorities where disclosure is required by law; or

  • emergency services or an appropriate person where there is a serious and immediate risk of harm.

Service providers are given access only to the information needed to perform their function.

Where you choose to join a WhatsApp or similar participant group, your telephone number, profile name and profile image may be visible to other group members. Joining such a group is optional.

I will not share confidential one-to-one information with another person without your permission unless disclosure is required by law or there is a serious and immediate safety concern.

11. International Transfers

Some of the service providers I use, including online platform and videoconferencing providers, may process information outside Ireland or the European Economic Area.

Where personal information is transferred outside the European Economic Area, I rely on an appropriate legal safeguard. This may include:

  • a European Commission adequacy decision;

  • the European Commission’s Standard Contractual Clauses;

  • an approved data-protection framework; or

  • another safeguard permitted under data protection law.

You may contact me if you would like more information about the safeguards relevant to a particular provider.

12. How Long I Keep Information

I keep personal information only for as long as it is needed for the purpose for which it was collected and to meet legal, insurance and professional obligations.

My usual retention periods are:

  • General enquiries that do not lead to a booking: normally up to 12 months after the last communication.

  • Confidential client forms and brief one-to-one session records: seven years after your last session, unless a different period is required for legal, insurance or professional reasons.

  • Booking, payment, invoice and accounting records: normally six years, in accordance with Irish tax record-keeping requirements.

  • Mailing-list information: until you unsubscribe or the mailing list is no longer being used, subject to periodic review.

  • Record of an unsubscribe request: a minimal record may be retained so that I can respect your preference not to receive marketing.

  • Course, community and member accounts: for as long as your account or access remains active and for a reasonable period afterwards.

  • Recordings: for as long as they are needed to provide the access described when you booked or joined the offering.

Information may be retained for longer where this is necessary because of a legal claim, investigation or other legal requirement.

Information that has been fully anonymised and can no longer identify you may be retained for statistical or planning purposes.

13. How I Protect Your Information

I use reasonable physical, administrative and technical measures to protect personal information.

These include:

  • keeping paper client records in secure storage;

  • using passwords and access controls for electronic systems;

  • limiting access to confidential information;

  • keeping software and devices appropriately protected; and

  • using reputable service providers.

Although I take appropriate care, no method of transmitting or storing information electronically can be guaranteed to be completely secure.

If a personal-data breach occurs, I will assess it and notify the Data Protection Commission and affected individuals where required by law.

14. Your Data-Protection Rights

Depending on the circumstances, you may have the right to:

  • ask for a copy of the personal information I hold about you;

  • ask me to correct inaccurate or incomplete information;

  • ask me to erase information where applicable;

  • ask me to restrict how information is used;

  • object to certain processing;

  • receive certain information in a portable format;

  • withdraw consent where processing is based on consent; and

  • complain to the Data Protection Commission.

These rights are not absolute, and there may be circumstances in which I am legally required or permitted to retain information.

15. Children and Young People

Direct one-to-one bookings and purchases through the website are intended for adults unless an arrangement has been made with a parent, guardian, school or responsible organisation.

Where I work with children or young people through a school, community group or other organisation, personal information will be handled under the relevant arrangements with that organisation. Parent or guardian consent will be obtained where appropriate.

Children and young people should not submit health information or make a direct online purchase without the involvement of an appropriate adult.

16. Automated Decision-Making

I do not use personal information to make solely automated decisions that have a legal or similarly significant effect on you.

17. Links to Other Websites

The website may contain links to third-party websites or services.

I do not control how those organisations collect or use personal information. You may wish to read their privacy notices before providing them with your information.

18. Changes to This Privacy Notice

I may update this privacy notice if my services, systems or legal obligations change.

The most recent version will be published on this page with the date of the latest update.

If I make a significant change that affects how existing client or member information is used, I will take reasonable steps to let those affected know.
